1. Issuer and role of gifty
Each gift card is issued and sold by the business (the "Merchant") identified in the store, the checkout, the purchase receipt or the gift card page. The Merchant is solely responsible for the offer, for the funds received, for the redeemable products or services, for the redemption, for the returns and for consumer care. APPS 4 SELLERS CORP ("gifty") provides the technological infrastructure to issue, deliver and manage the gift cards: it does not receive the sale price, is not a party to the sale and does not assume the Merchant's debt toward the consumer, unless expressly stated otherwise or an applicable mandatory rule provides so.
2. Offer, purchase and activation
Before purchase, the offer must clearly disclose the price, the face value, the currency, the validity period, the redemption channels, the applicable restrictions, the taxes and the return policy. What is disclosed in the offer at the time of purchase governs that gift card and cannot be worsened retroactively.
The gift card is activated when the platform confirms the payment operation and the issuance. A pending purchase email or message does not prove activation: if the payment was rejected, canceled or reversed, the gift card may not be issued or may be voided, in accordance with Section 7.
3. Delivery and recipient
Delivery may be immediate or scheduled for a chosen date, by email, WhatsApp, link or another available channel. The buyer is responsible for providing correct contact details of the recipient and for having authorization to share them. An incorrect detail may prevent or misdirect delivery; the Merchant must offer a reasonable means of correction and resending, subject to anti-fraud checks. If delivery fails for reasons attributable to the platform, it is retried or a reasonable solution is offered in accordance with Section 8.
4. Code, link and security
The gift card's code or link works as a bearer credential: whoever holds it may attempt to redeem it. Keep it private, do not publish it on social media or forward it to strangers, and always verify that the links belong to the store's or gifty's domain before entering data.
Report immediately to the Merchant any loss, phishing or unrecognized use. The Merchant may block, rotate or reissue a gift card after verifying ownership and balance. Recovery of the value is not guaranteed if a third party validly redeemed the gift card before the notice, without prejudice to the rights granted by law.
5. Redemption, balance and currency
The gift card is single-use and is used in the store and currency stated in the offer. Applying the code consumes its value in full even if the purchase costs less; no remaining balance is available for another purchase. Unless the law or the offer provides otherwise, the gift card is not legal tender, does not accrue interest and is not redeemable for cash or convertible to another currency.
In the event of a discrepancy between what you see and what the system records, the platform's reconciled records govern, without prejudice to your right to request a review of the operation and to receive an explanation.
6. Validity period and restrictions
The expiration and the use restrictions must be prominently disclosed before purchase and on the gift card itself. No expirations or restrictions apply where the law prohibits them or requires longer minimum periods: in that case the law governs. Reasonable exclusions (for example, particular products or combination with other promotions) are valid only if they were disclosed before purchase and can never be worsened retroactively for gift cards already sold.
7. Cancellations, returns and chargebacks
Cancellations and returns of the purchase of a gift card are governed by the Merchant's policy and by applicable law, including the rights of withdrawal or rescission that apply in distance purchases. If a purchase paid in whole or in part with a gift card is returned, the Merchant must state how the value is restored: balance replenishment, replacement or another means permitted by law.
If the original purchase of the gift card turns out to be fraudulent, is returned or suffers a chargeback, the Merchant may suspend or void the unused balance of that gift card, always respecting the rights that the law recognizes to the third-party acquirer or recipient acting in good faith.
8. Failures and support
In the event of a delivery that does not arrive, an incorrect balance or a redemption failure, first contact the Merchant with your receipt, without publishing the full code in open channels. The Merchant will investigate with gifty and the providers involved. A temporary unavailability of the system does not extinguish the value of the gift card: the redemption should be retried or a reasonable solution provided. Gifty may request the minimum data necessary to verify the operation and prevent fraud.
9. Secret gifts
The Secret gift option hides the buyer's name only in the communications and pages of Gifty directed at the recipient, who sees a generic label in its place. It does not create anonymity toward the Merchant, toward Gifty or toward the payment or ecommerce providers, and it does not prevent identifying the buyer through receipts, the buyer's own messages, contact outside the platform or a legal requirement. The choice can only be changed before the first delivery.
10. Consumer rights, privacy and precedence
Nothing in these Conditions limits the non-waivable rights that consumer protection rules recognize to you, including truthful information, dignified treatment, warranties, withdrawal or refund where applicable. If a clause contradicts a mandatory rule of your country, the rule prevails. The Merchant is the one who sets its commercial conditions and handles consumer claims; the processing of your data is governed by the Merchant's privacy notice and by gifty's Privacy Policy.
